BY USING ANY WEBSITE, MOBILE APP, OR SERVICE OF UTILITY VALET LLC, YOU AGREE TO ABIDE BY THESE TERMS OF SERVICE BETWEEN YOU AND UTILITY VALET LLC, WHICH INCLUDE THE REFERENCED PRIVACY POLICY (“AGREEMENT”). IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, YOU ARE NOT AUTHORIZED TO USE ANY UTILITY VALET LLC WEBSITE OR TO OBTAIN ANY SERVICES FROM UTILITY VALET LLC.
The Utility Valet LLC websites, mobile apps, and customer portals (collectively, “Websites”; and individually, “Website”), along with Utility Valet LLC provides numerous services, including as referenced on the Websites (“Services”).
Utility Valet LLC reserves the right, at its discretion, to revise the terms of this Agreement and/or change, suspend, discontinue, or modify any aspect of any Website. Your continued use of any Website after the posting of revisions constitutes acceptance
of the revised terms.
1. Business Identity
Utility Valet LLC is a utility billing management and submetering services company. We specialize in providing utility account management, billing and payment processing, usage tracking and reporting, and customer support services to property owners,
managers, and residents. Our services help streamline utility management for multi-family residential properties and commercial buildings.
2. Certification of User
By using or attempting to use this Website, you certify that you are a resident of the United States or otherwise authorized to conduct business in the United States, are at least 18 years of age, and have the legal capacity to enter into this Agreement.
3. Content and Registration
3.1 Website Content
Website content includes all areas and aspects of the Website and Services, including text, data, photos, graphics, video, software, products, services, and information provided by Utility Valet LLC.
3.2 Vendor Content
Utility Valet LLC may display or link to information, products, or services offered by third-party vendors. Utility Valet LLC does not guarantee the accuracy, availability, or quality of any vendor content and does not endorse vendor products or services.
3.3 Third-Party Liability
Utility Valet LLC is not responsible for losses or damages resulting from external sites, vendor information, or vendor products or services.
3.4 Registration
Certain Website features may require registration. You agree to maintain confidentiality of your login credentials and acknowledge that Utility Valet LLC may discontinue your access at any time. If you believe your account has been compromised, you must notify us immediately at (469) 949-4309 or support@utilityvalet.io.
4. SMS/Text Messaging Terms
4.1 SMS Program Description and Consent
By providing your mobile phone number through any Utility Valet LLC web form, service registration, customer portal, or other communication channel, you expressly consent to receive text messages (SMS and/or MMS) from Utility Valet LLC or its representatives.
Purpose of SMS Communications
We use SMS communications for non-marketing purposes only, including:
- Account setup and activation notifications
- Meeting and appointment reminders
- Service scheduling confirmations
- Critical account updates and notifications
- Emergency service alerts
- Billing notifications and payment confirmations
- Service interruption notices
- Response messages to your inquiries
We do not send marketing or promotional messages via SMS.
Types of Messages You Will Receive
When you provide your mobile number, you may receive messages such as:
- Welcome/Account Setup: “Welcome to Utility Valet! Your account has been activated. For support, reply HELP or call (469) 949-4309. Reply STOP to opt out. Msg&data rates may apply.”
- Appointment Reminders: “Reminder: Your utility service appointment is scheduled for [date] at [time]. Reply to confirm or call (469) 949-4309 to reschedule.”
- Billing Notifications: “Your Utility Valet bill of $[amount] is due on [date]. Visit [link] to pay now or set up autopay.”
- Service Updates: “Your utility account settings have been updated. If you did not make this change, contact us immediately at (469) 949-4309.”
- Emergency Notifications: “URGENT: Water service interruption in your building due to emergency repair. Estimated restoration: [time].”
Message Frequency and Data Rates
You may receive 5-15 messages per month, though message frequency may vary depending on your account activity and service needs. Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Consent Not Required for Service: You are not required to consent to receive SMS messages as a condition of using Utility Valet LLC’s services. However, opting out may limit your ability to receive timely account notifications and service updates.
4.2 Opt-Out and Support
You can cancel the SMS service at any time. Just text “STOP” to (469) 949-4309. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

4.3 Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Mobile carriers are not responsible for the delivery or timing of messages sent by Utility Valet LLC. Message delivery may be affected by network coverage and availability, mobile device compatibility, carrier technical issues, and device settings or spam filters. Utility Valet LLC is not responsible for messages that are not delivered due to carrier-related issues, device incompatibility, or other technical factors beyond our control.
4.4 Privacy Policy Cross-Reference

5. Limitations on Use
5.1 Copyright and Trademarks
All Website content is copyrighted by Utility Valet LLC or its licensors. You may not copy, reproduce, distribute, or exploit any content without prior written permission, except for personal, non-commercial use.
5.2 Restricted Use
You agree to use the Website lawfully and not transmit content that is unlawful, infringing, abusive, obscene, or otherwise objectionable.
5.3 User Submissions
By submitting content to Utility Valet LLC, you grant a perpetual, royalty-free, irrevocable license for Utility Valet LLC to use, modify, distribute, and display such content.
6. Access and Delays in Services
Utility Valet LLC is not liable for service interruptions, delays, or errors caused by events beyond its control.
7. Representations, Warranties, and Limitation of Liability
7.1 Disclaimer
The Website is provided “as is” without warranties of any kind. Utility Valet LLC disclaims all implied and express warranties.
7.2 Assumption of Risk
You assume all risks related to Website use and data accuracy.
7.3 Limitation of Liability
Utility Valet LLC shall not be liable for incidental or consequential damages. Any liability is limited to the greater of $100 or 10% of amounts paid by you.

You agree to indemnify and hold harmless Utility Valet LLC and its affiliates from all claims arising from your use of the Website or Services, including SMS communications.

10. Unsolicited Marketing

11. Miscellaneous
11.1 Governing Law
This Agreement is governed by the laws of the State of Texas, with venue in Collin County, Texas.
11.2 Assignment
You may not assign your rights without written consent from Utility Valet LLC.
11.3 Severability
If any provision is unenforceable, the remainder shall remain in effect.
11.4 Connectivity Charges
You are responsible for any third-party connectivity charges incurred, including charges related to SMS messaging.
11.5 Termination
Utility Valet LLC may terminate your access at any time without affecting its legal rights.

11.7 Entire Agreement
